Council Assessment Panel

On the back of the commencement of the Planning, Development and Infrastructure Act, Council established the Council Assessment Panel (CAP) on the 13 of June 2017.

The role of the CAP is to make decisions to either approve or refuse certain types of development applications. The Council’s Development Act Delegations Policy provides more detail on the role of the CAP and applications that they consider and determine.

Code of Conduct

Members of the CAP are required to strictly adhere to the State Government's Code of Conduct. Any complaints regarding the conduct of a CAP member must be referred to the South Australian Planning Commission.

As part of the implementation of the reformed planning system, the Minister for Planning, the Hon. John Rau, has reviewed the Code of Conduct for CAP members. The new Code of Conduct can be found here: Code of Conduct - Assessment Panel Members


The CAP has a total of four members, and one deputy member.

Of the five members, there is one Elected Member of the Council, and four members that are independent of the Council. The Council selected the independent members through an Expression of Interest process that was open to members of the public.

The CAP members are:

David Billington (independent Presiding Member) 
Steve Hooper (independent member)
Rebecca Rutschack (independent member)
Michael Osborn (independent member)
Andrew Tilley (Council member)
Yvonne Todd (deputy Council member)

Note: Yvonne Todd is only able to act as a deputy member in the absence of Andrew Tilley, and is unable to act as a deputy member in the absence of the Presiding Member or other independent members.

Meeting Venue, Dates and Time

Council Assessment Panel meetings are held on the first Thursday of each month (excluding January), commencing at 6.30pm at the City of Mitcham Civic Centre, 131 Belair Road, Torrens Park.

Special meetings may be held as and when required.

Making a Verbal Presentation to the Panel

If you have made an application to undertake development in the City of Mitcham and the CAP is the decision maker, you are able to speak to the Panel in support of your application at the discretion of the Presiding Member.

If you have been notified of a development being undertaken by someone on a neighbouring property, and you have made a submission to the Council in relation to that development within the time frame allotted by the Council, you are able to speak to the CAP in support of your submission.

In these cases, applicants are also able to speak to the CAP to respond to submissions from neighbours.

Notice of Next Meeting

The next monthly Council Assessment Panel Meeting will be held in Council Chambers on Thursday, 3 December 2020 commencing at 6.30pm.
