New smoke-free and vape-free laws

From 1 March 2024, new laws ban smoking and vaping in public outdoor areas across South Australia.

Regulations under the South Australian Tobacco and E-Cigarette Products Act 1997, have been introduced to address risks associated with passive tobacco smoking and passive inhalation of e-cigarette aerosol.

  • Early childhood services premises, education and children’s services facilities (including schools), and within ten (10) metres of their boundaries.
  • Non-residential building entrances, such as those of shopping centres, government and commercial buildings, and within ten (10) metres of these entrances.
  • Public hospitals and health facilities, private hospitals, and residential aged care facilities, along with areas within ten (10) metres of their boundaries (Note: The regulation for residential aged care facilities will come into operation 12 months after the other regulations).
  • Outdoor public swimming facilities.
  • Major events venues declared under the Major Events Act 2013.
  • Sporting venues during organised underage sporting events, training, or practice sessions, and within ten (10) metres of these venues.
  • Beaches between and within fifty (50) metres of red and yellow patrol flags, and beneath (and within five (5) metres of) jetties.

Building maintenance requests

Your Club's lease and licence documents outline the specific maintenance responsibilities for both the club and Council. It's important to note that if the club chooses to hire its own contractor, Council cannot cover any associated costs.

Annual lease and licence holder information

Each year club lease and licence holders must provide Council a copy of the clubs:

  • Public liability insurance (covering up to $20m)
  • Annual report and/or AGM minutes
  • Audited financial report
  • Contact details of the best contact for your club (if it has changed)
  • Proof of testing and tagging all appliances.

These documents must be submitted each year to Council via email at mitcham@mitchamcouncil.sa.gov.au

How to apply for landowner consent

If you're a lessee or licensee of Council facilities and plan to make alterations or additions to your leased or licensed area, you must obtain landowner consent first.
